1.About these terms

These terms apply every time you visit raineandco.co.za or place an order with us. By placing an order you agree to them, so please read them carefully. Nothing in these terms takes away rights you have under the Consumer Protection Act 68 of 2008 (CPA) or the Electronic Communications and Transactions Act 25 of 2002 (ECTA).

We have written them in plain language. If anything is unclear, email us at hello@raineandco.co.za before you order.

2.Who we are

Raine & Co is the trading name of a South African private company. Our full registered name, registration number, address and the other details ECTA requires are on our Legal and company information page.

3.Using the website

• You must be 18 or older to place an order, or use the website with the involvement of a parent or guardian.
• Please keep your account details private. You are responsible for orders placed through your account.
• Do not use the website in a way that harms it, other customers or us, such as trying to gain access to systems you are not authorised to use.

4.Placing an order

When you place an order you make an offer to buy. We send an email confirming that we have received it. The contract between us is formed when we email you to say your order has been dispatched.

We may decline or cancel an order, for example if an item is out of stock, if a price was shown in error, or if we cannot confirm payment. If we cancel after you have paid, we refund you in full to the original payment method.

Before you confirm, the checkout shows the items, the total price including delivery, and the payment options. You can correct any mistakes before you pay.

5.Prices and payment

Prices are in South African rand and include VAT where it applies. The delivery cost is shown at checkout before you pay. If a price on the website is clearly wrong, we will contact you before dispatch and you may cancel the order for a full refund.

You can pay by card, instant EFT, Payflex or PayJustNow. Payments are processed by our payment providers on their secure systems; we never see or store your full card details. Instalment plans are agreements between you and the instalment provider, on their terms.

6.Delivery

We deliver across South Africa. Delivery is free on orders over R1 000; for smaller orders, the delivery cost for your address is shown at checkout before you pay. Delivery times are on our delivery page and in our shipping policy. Delivery times are estimates, not guarantees. The risk in your order passes to you when it is delivered to the address you gave us.

7.Cancelling within 7 days (cooling-off)

Under section 44 of ECTA you may cancel your order without giving a reason and without penalty within 7 days of receiving your items. You only pay the direct cost of returning them. We refund what you paid within 30 days of receiving your cancellation and the items. See our refund policy for how to cancel.

8.Returns and faulty items

Beyond the cooling-off period, you may return unused items within 30 days for a refund or exchange, as set out in our refund policy. You pay the shipping cost of sending a return back to us, except for faulty items.

Under section 56 of the CPA, if an item is faulty within 6 months of delivery you may choose a repair, a replacement or a refund. This does not cover normal wear, damage from misuse, or loss.

9.Product information

Our jewellery is 18k gold PVD on a 316L stainless steel base. We describe each piece as accurately as we can, including size and finish. Photographs are true to the pieces, but colours can look slightly different on different screens, and the finish of handmade details can vary a little between pieces.

10.Gift cards

Gift cards are valid for 3 years from the date of issue, or until the full value is used. The expiry date is shown on every gift card. They cannot be exchanged for cash. Treat the code like cash: we cannot replace a code that someone else has used.

11.Promotions and competitions

Discount codes apply only as described in the promotion and cannot be combined unless we say so. Competitions follow our competition terms and the rules published with each competition.

12.Reviews and content you share

If you post a review or share content with us, you confirm that it is honest and your own, and you allow us to show it on our website and social channels with the name you choose to display. We may remove content that is offensive, unlawful or unrelated to the product.

13.Our content

The Raine & Co name, logo, photographs, text and website design belong to us or our licensors. You may share links to our pages, but you may not copy or reuse our content for commercial purposes without written permission.

14.Our responsibility to you

We are responsible for losses you suffer that are a foreseeable result of us breaking these terms or failing to use reasonable care. We are not responsible for losses that are not foreseeable, or for business losses. Nothing in these terms limits our liability where the law does not allow it to be limited, including under the CPA.

15.Your privacy

We handle your personal information as set out in our privacy policy and our cookie policy.

16.Changes to these terms

We may update these terms from time to time. The version on the website when you place an order applies to that order. The date at the top shows when they last changed.

17.Law and disputes

These terms are governed by South African law. If something goes wrong, please contact us first at hello@raineandco.co.za and we will try to put it right quickly.

If we cannot resolve it, you may refer a complaint to the Consumer Goods and Services Ombud (cgso.org.za) or the National Consumer Commission, or approach a court with jurisdiction.
